Found this while searching the website of the Senate Judiciary committee. Even though it is more than a month old, the references to SKIL bill in the hearing offers a glimmer of hope to us..As I understand the SKIL bill has been referred to the same committee for several months now.

I would appreciate if somebody can provide information on how to transfer my present H1 from a company to H1 from an university. I know that H1 from university does not come under quota. Is is a regular H1 transfer?

I am planning to complain against my employer for not paying bench pay. He says he can prove that I never reported to him. I got my status changed from H4-H1B since October2008. He already got a signed leave letter from me . Now I would like to come back to legal status. When I make a complaint to DOL how can I prove that I worked for this employer. I never visited their office personally. All the communications happened through phone and email.
We had many e-mail communications between October to till-date. Is this enough to prove my case? How can he defend himself saying that I never reported to him. I am genuine candidate with real experience and never faked my resume. I am ready to face any legal issues. Please guide me how to proceed.

Do we need to have the original receipt notices.
I asked my attorney and he said that the copies would be fine.
He sent me scanned receipt notices via e-mail and says that it will
be fine and not ready to send the originals for some reason.
Can you guys think of any reason attorney not willing to give the original receipt notices?

Guess its easier.. and then they give negative reps instead of answers... Anyway.. Seems IV is losing focus and with this attitude of majority.. many more will go away...
I'll request all contributors to feel proud but don't boast all the time of your contributions and expect contributions from the others rather than questions...

People will contribute at their pace and in the manner they feel good... You just can't force them... without being an example...

I am planning to visit India next month. I will transit thru Dubai in Emirates Airlines from West Coast. My 485 is pending and have valid AP and EAD. I have expired H1B visa stamp in my passport.
Did anyone use AP in this route?. Will I have any issues with Emirates Airlines and during transit in Dubai using Advane Parole?.
Please someone help me.

I am on a L1 visa which has expired April 2006. I have got my petition extended till 2008. Can I transfer my L1 from Employer A to another Employer B. Can employer B transfer my current L1 petition to his company?

I live in GA. My 485 was filed at NSC and was receipted at CSC and transferred back to NSC.
As per the filing instructions, I will have to file EAD at Texas Service Center.
But some folks told me to file at the location where I-485 is pending.
I have the following questions
a> Where should I file my EAD renewal
b> Is it true, paper based EAD renewal does not require finger printing

Hi,
My Perm LC is applied in DEC 2007, GOT AUDIT RFE last week.
I am really worried about RFE. My Employer advised me we need reply them quickly in 1 week so that they feel we are serious.
Mine is BE+5years, applied under EB2 CATEGORY. I have 9+years of experience.
My employer advised me create a document which explains the Job Duties and responsibilites etc project by project.
and documnets including resume, experience letters, etc.
Can any body explain me what exactly uscis is expecting from me , what kind documents/avidence they are expecting in RFE ?

Please provide documents such as position descriptions, the percentage of time spent on the various duties, organizational charts, and payroll records demonstarting that the qualifying experience gained by the alien while working for the employer, including as a contract employee, was ina position not substantially, i.e., not requiring performance of the same job duties more than 50 percent of the time to the position for which certification is being sought, and/or documents demonstarting that it is no longer feasible to train a worker to qualify for the position.

In the past few years, the USCIS and US Department of Labor have suspected newer and small companies of fraud, especially within the immigration system. New procedures and increased scrutiny (http://www.immigrationvisaattorneyblog.com/2009/04/h1b-quota-still-open.html) of employment-based cases have made H-1B petitions and H-1B visas especially more difficult to attain.

I am currently working on OPT. My company has just applied for my H1B visa. Assuming it gets approved in 2-3 months time (i.e. in March), when can i have it stamped? Can i go back to my home country to get it stamped in April or will i have to wait till 1st Oct 2011 to get it stamped?
What is the starting date on your H1-B petition?
You cannot get a VISA stamp earlier than within 20 days of the start date (I actually do not recall if it is 20 days or 15 days -- but it is around that many days).

Is it permitted to enter the US on a tourist visa and while you are here, can you start working since H1B approval has been received? The reason I ask is that my some time is needed to set up an apartment, get SSN etc. and it would be easier to come a little early while H1B is being processed. Can you get the H1B stamped in the passport later in Canada? Thanks in advance!

This visa has initially been sponsored by a company, so I can only work for this company
A lawyer told me that I could self-sponsor another o1 and then be able to work for as much company I want. I have an agent but he is not able to guarantee full time employment.
So I am wondering if I should do that or not.. What are the exact salary requirements for a self-sponsored o1?
I got a good folder, awards, recommendations and publications.
