I have my H1 filed in 2008. Due to the market situation, I didn't go for H1 stamping and was never active on H1 so far. I entered US in March 2009 on H4. Now I got a project and want to go for the H4->H1 COS.
I would like to know the steps/process for H4 -> H1 COS.
I know my employer is the best person to answer this. But, the problem is whenever I ask any details, he always tries to abstract the info.
If there are sequence of steps, after which step one is authorized to work? I tried getting the info online, but couldn't . If any of you can give me a pointer or explain the process in detail, it would be very great and helpful.
My employer has applied for LCA. He says that he would initiate the COS process as soon as he gets the LCA. And my employer says that I can start working as soon as he files for COS and no need to wait for the approval. I want to make sure that I don't run into any legal issues. Once the employer has initiated the COS process, is there a way one can track the status and also to verify the status after the completion of the process.
Also, please let me know how much it would cost for normal and premium processing and also the time lines for the normal and premium processing.
Sorry for too many questions. But, please please do help!!!

Hi folks,
I am on H1B visa currently, set to expire in two months from now (end of September). I need to get my H1B renewed for the next 3 yrs. Due to unavoidable reasons my lawyer has not been able to file for the renewal yet.
My questions are -
1. Do I need to have the approval notice before my expiration date?
2. I plan to travel internationally in November. Would the receipt notice be acceptable to reenter? Or do I need the approval notice?
Any suggestions are most welcome. Thanks in advance.

my manager decided that he is going to RIF me in October. I just filed for my AOS and EAD last week. So i would assume my receipt date would be some time in July.
I already have my I-140 approved with PD of Mar 2004
Please suggest what do I need to do ?. Since July to October is like 3 -months, I can get an EAD ( atleast Interim ).

Hi All,
Currently iam working for a X company and i do have 2 layers(A,B) to my end client Y. My company got agreement with company A and A got agreement with B. Now, my client (Y)wants me on full time.I have signed non-compete with my employer that i will not join his clients.But Y is no way a client to my employer. Will there be any issue if i join with Y?
Any replies is highly appreciated.

First, submit a change of address form on USCIS web site for you and your wife. Have all of your receipts ready - after the general change of address form you will need to submit one for every petition (!) you have pending.
After you receive all of the change of address confirmations from USCIS (takes about a week), make an InfoPass appointment or juggle the call center system into transferring to your service center to talk to an immigration officer - please make sure all of your addresses got changed.
Don't forget to foreward mail at the post office.
I applied under EB2-NIW on July 28, 2007. Under the concurrent filing allowed at that time, I submitted NIW, I-140, I485, and EAD applications for me and my wife. I have changed jobs, and joined a new company last week.
Since I filed a self-petition, my application should not be directly affected by this move. However what do I need to do to inform uscis about this change, so that my receipts/EAD etc. do not go to the wrong place, or worse, get returned by the post office.

By law, you should have the originals on you when you travel, in some cases even domestically. So, you may definitely ask your lawyer to send you the originals.

The first I -797 notice that I got, states that they received my I-485 application on July 16, 2007. On the website for USCIS status update, it states that they received my application on September 8, 2007.
According to my understanding, one does not have to submit the $340 application fee for a work permit if they received the notice AFTER July 30, 2007. This is where it gets confusing.
Here's the problem...if they say on my paper notice that they received the application on July 16, 2007, then I would have to pay the $340.00 - correct?
But if the website states that they received it on September 8, 2007, then I would not have to pay the fee.
I need a job, plain and simple. I have been in this country for 6 years and have not had a single paycheck. I get room and board for taking care of an elderly disabled person and that's it. Any money I do get is from the kindness of friends and family or maybe babysitting for a friend etc.
I cannot afford the fee, but I don't want to take the time to fill out and submit the application if I have to pay.
How do I determine which notice to follow? Should I assume I have to pay the $340 and try to do so by borrowing the money from someone and if it wasn't necessary will they give it back? Me and my wife received our EADs and our H1/H4 is valid till 2010.
My wife is attending school being on H4. Since she has EAD, can she work part time(not in school) and keep the H4 status valid.
Please suggest.
Yes, She can work using EAD part time or fulltime. But if she uses EAD, the H4gets invalidated automatically, She should keep renewing the EAD / AP.
Why you want to have the H4 status valid ??

i transferred from one dept to another. the next dept filed for a H1B amend after 4 months. The lawyers filled in my G325 with the earlier, start date (and not the later filing date).

It's always good to have the right info on the form. If I remember correctly - you may request to correct the info 48 hours before your scheduled interview at the respective consulate or VFS (please double check).
I have had issues before with the online form i.e. my full address was not printed out correctly, in another situation I filled the form for my parents and forgot to sign the form (prepared by). There was never an issue. We all got VISA without a question

To answer your questions, In first place this program comes up with few clauses. Your eligibility to apply for this program is contingent upon the fact that you hold a current H1B and are working on H1B for atleast one year. It is also important to prove your H1B status when you get your permanent residency with Canada. With the over flow of applications, they added another clause in the form of eligibility which will make only "IT Managers" eligible for this category. They were taking applications with all NOC codes but offlate around May 29, the eligibility is dependent on your IT Manager role.
