Hi Immigration Gurus,
I have a valid H1B Visa which is expiring on Feb 16th, 2008 and my old H1 is expiring the same day as my Visa. I applied for my H1B extension my H1 extension is pending. I am planning to go to india on Dec last week and coming back on jan 7th.
1) Can I travel without any problems/
2) While coming back, what are the documents I need to show, will my old H1 is enough or do I have to show receipt of showing I applied for extension?
I really appreciate your time and advice, advanced thanks

It won't be through any company. It would be through the school itself. If the school needs a teacher then it can file for his/her h1b.

No one Interfiled so far??
I don't know if its a failure or success so far, as my Name check is not cleared and USCIS is not touching the file.

I am just trying to outline our plight. And that federal agencies should know that if we do our part according to deadlines set, then they should do their part too. Remember it's all based on reciprocity! Thank You guys, I appreaciate your sincerity.

Dear All,
In response to my service request on 9th Sept 2009, my I485 has been transferred to the USCIS Hialeah Florida office for further processing. Normally I -485 cases are forwarded to local offices for the purposes of scheduling an in-person interview. In my case I live in New York and no way connected to FL. I am curious anybody or any of your friends have similar experience.
I really appreciate your response.

I just found this link (http://immigrationvoice.blogspot.com/) where this topic is already covered. Mods, please remove my post (and maybe it would make sense to create threads specific to the USCIS/DOS mess up to - at the moment it does not look very organized to me and it is hard to find information. Maybe sub-threads with "law suit", "publicity" would channel comments better?)
--------------------------------------
I only read about an article in two online newspapers but believe this whole topic should get significantly more attention. I do not know if that is going to help to get this started but I sent an e-mail to our local TV stations and hope that some may be interested and even pick it up. Again, no idea if this is going to work but I assume that if they get more e-mails regarding the same topic, interest will come up....

Hi,
With having many international operating companies in the U.S. who all employ legal alliens who are going through the "greencard process" to become legal permanent residents, the Department of State (DOS) and the U.S. Citizenship and Immigration Services (USCIS) have destroyed many plans, caused significant financial loss for applicants and very likely acted against the law. Here is an open letter from congresswoman Lofgren which explains the situation a little bit more detailed: http://lofgren.house.gov/PRArticle.aspx?NewsID=1808
I think this would be well worth a few minuted report - everybody is talking about the pain that the illegal immigrants go through but (without taking away anything from that), the pain of legal alliens having to deal with the willful behavior of USCIS and DOS is not much better.
If you would be interested in more information, I would be more than happy to help.
Best regards,

Thank you for the info! Should I give my lawyer a heads up or not worry about changing address on the application (if they still can do that)?
Changing your address using AR-11 does not affect any existing petition. To change your address on any outstanding application you need to call the USCIS customer service number. So relax, this has no effect on your application.

10/17/2007: Total of 60,000+ EB-485 Applications Adjudicated During July-August-September by NSC and TSC
* AILA has reported that during the period of July, August, and September 2007, Nebraska Service Center and Texas Service Center adjudicated 60,000 plus EB-485 applications. Since EB visa number was unavailable for the entire EB cases in August, presumedly a substantial portion of these cases could include those cases for which the EB visa numbers were pull out before July 2, 2007 in June and adjudicated throughout the period as reported by some I-485 applicants who reported that their I-485 applications were approved when the visa number was unavailable. Interesting.

Hello, I am on H1B with an employer with dates from sep 2005 to sep 2008. I am amending my petition (with a new lca) as well as extending it for the same company. The amendment date will be from April 1st.
Now my question is shd my extension (with amendment) be from April 2008 to April 2011 or can it be for the remainder of 6 years that is April 2011 to Sep 2011. Please let me know. Thanks

Hi,
I received a notice this morning for my spouse's case! This is the third (or may be fourth) time they have transferred the case! The notice reads:
On May 16, 2011, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our TEXAS SERVICE CENTER location for processing because they now have jurisdiction over the case. .......
During this step, USCIS initiates the background checks of the applicant/petitioner and identifies issues that may need to .........
All standard stuff. Not sure what that means. We are getting current on June 1st. I have not received any such notice for my case, only for my spouse's case.
By the way, we have never been interviewed, have provided fingerprints probably three times.
Does that mean that now the case needs additional 4 to 6 months of processing?
Regards,
Fall1998.

If you were subject to the cap for the last H-1B, you will not be subject again. The new employer would need to file a change of status for you, changing you from B-2 back to H-1B.

You could travel out and enter into US using your old visa stamp assuming that you enter before your old visa stamp expires. However show the new approved I-797 H1B petition at port of entry and they MOSTLY will give you a new I-94 valid till the expiration of new I-797 approval.
That's wonderful news and thank you for that. Is there a benefit of getting a 1-94 upto the extended date, does 1-94 determine the visa validity not the actual visa stamp? Since I-94 is taken when exiting US the next entry requires visa stamp anyway?
Thanks again.

Doesn't the date fall on a Sunday? It is probably a system update: I belive that similar things have happened to others. Don't worry and enjoy your weekend.
My EB2- I140 (INDIA) approved on March 09, 2007. We also have received our EAD last year after filing I-485 in July 2007.
I was checking online status and for my I-140, last updated date shows January 06, 2008. (My EB2 PD is OCT 2006). Can any one explain why the I-140 showing update date of 01/06/2008. The online status says following text :
Application Type: I140, IMMIGRANT PETITION FOR ALIEN WORKER
Current Status: Case approved; approval notice e-mailed.
On March 9, 2007, this I140 IMMIGRANT PETITION FOR ALIEN WORKER was approved and we sent you an e-mail notice. Please follow any instructions on the notice. If you move before you receive the notice, call customer service.
I am little bit confuse.
I appriciate your help.
Thank you.

your old 140 will still be valid even if the new one is deneid and as long its not withdrawn or revoked by USCIS. You should be able to get 3 yrs H1 based on your approved 140. Hope this helps.
